General:
⟡ By commissioning me you confirm that you have read and fully agree to my TOS.

⟡ I will not start a commission until payment is received.

⟡ Be sure to provide clear references. I, sadly, cannot work off of only text descriptions of a character.

⟡ The commissioner is solely responsible for ensuring that the artwork abides by the rules and TOS wherever it will be used. I, Exxtrai, am not responsible for any artwork rejected by any site it is posted to (i.e Twitch, Twitter, etc.).

⟡ Each commission will have the option to use up to 4 major revisions during the sketch phase. Minor revisions are allowed throughout the entire process.
    ⤷ Any Major Revision requests during the lineart phase will be denied.
    ⤷ "Major Revisions" include, but are not limited to; Change of outfit, Change of pose, Change of hairstyle, or anything that causes me to need to redraw something completely.
    ⤷ Please ask if you're unsure about revisions.


Payments:
⟡ I may offer payment plans to recurring clients of up to 4 payments depending on the commission.
    ⤷ Please contact me prior to commissioning me to discuss this.

⟡ If no payment plan: 100% of payment is due upon commissioning.



Delivery:

⟡ I try to deliver an art piece within 1 month of commissioning.
    ⤷ I do work a part-time job outside of doing art which can impact delivery date to an absolute max of 3 months. Should irl work interfere with delivery deadlines I will communicate that to you to ensure it's okay.
⟡ Completed work will be delivered via vgen/discord/email (depending on where you place your commission request), please let me know if you'd like it delivered in another form as well (i.e; Discord, Email, etc)!



Rush Fees:

⟡ Rush fees will vary depending on current workload, please contact me prior to commissioning to discuss.



Cancellations:

⟡ I have the right to cancel and refund your commission at any time if I feel unable to complete your request to the best of my ability. *this will always be discussed with you prior to my conclusion.

⟡ You reserve the right to cancel your commission fully before any payment is made.

⟡ During the sketching process, you may cancel and receive a 50% refund.

⟡ Once the lineart process has begun, you are unable to cancel/request refund your commission.


Rights:

⟡ I hold every right to each commission and drawing I create. This means that I'm allowed to display, promote, and publish the piece in any place or website.

⟡ You are allowed to use the commission for personal use. You can post the commission on social media, use for streaming assets, any social media posts, pfps, banners, etc.
    ⤷ Please give credit to me somewhere (@exxtrai as opposed to @/exxtrai)!

⟡ You're welcome to print the commission out and display it in your own personal space; and if the commission is a gift these same rights apply to the recipient.

⟡ If you would like commercial rights to the image there will be an increase in price - this will typically be 50% of the commission cost.
    ⤷ This includes any sort of physical merchandise product (i.e t-shirts, stickers, prints, cups, etc.).

⟡ You may not use the artwork/commission for commercial purposes without purchasing the rights.


The Art:

⟡ I strive to create art to the best of my ability and warrant the commission will be 100% original to my knowledge. I do reserve the right to use commercially licensed, copyright-free, or educational materials/assets/references/or tools in the creation process. I will not trace/copy/or heavily reference unauthorized materials.

⟡ I will only be drawing in my own art style. I am okay using other artists for inspiration materials, but will always refuse requests to blatantly copy another artist’s style.

⟡ Usage of my work for AI (Artificial Intelligence) tools, platforms, or programs; ML (Machine Learning) tools, platforms, or programs; AI or ML training; NFTs; Blockchain; or any other for-profit platforms/purposes is strictly prohibited.

⟡ You may not make any changes or edits to your commission on your own or via a third party without my explicit approval. Please contact me beforehand, I might offer to make the changes myself!

⟡ You may not take credit for the creation of the commissioned piece or remove any watermarks/signatures.
    ⤷ Again, please credit me directly when posting it. (please use @exxtrai as opposed to @/exxtrai)

⟡ Purchasing commercial rights to the commission does not forfeit my rights to posting the artwork on my social media or other websites, unless agreed otherwise.
